Warranty
Section 1 - GENERAL WARRANTY DETAILS
MYTHLOGIC CORPORATION (MYTHLOGIC) warrants to the original purchaser that any part of the hardware system excluding software, documentation and similar items will be free of defects in workmanship and materials for the period of your warranty from the date of delivery. During the warranty period, MYTHLOGIC will repair or replace, at its sole discretion, the defective hardware system, free of charge for labor and parts. If the product is defective within the first 180 days MYTHLOGIC will cover the cost of shipping the item. MYTHLOGIC will not be held responsible for covering shipping costs after 6 months of receiving your computer system.
The MYTHLOGIC “Sentinel” Warranty covers normal use only. This Limited Warranty does not cover damage caused during shipment (except during shipment to the original purchaser) and any damage caused by actions that are beyond MYTHLOGIC Corporation’s control, including, but not limited to, liquids, collision, flood, wind, earthquake, lightening or similar disaster, war, lockout, epidemic, destruction of shelter, unauthorized modifications, attachment of peripherals (not shipped from MYTHLOGIC), improper use, environment, installation or electrical supply; improper maintenance; any other misuse, abuse or mishandling. This Limited warranty does not cover software or non-MYTHLOGIC branded products. Any warranty applicable to software or non-MYTHLOGIC branded products is provided by the original manufacturer.
MYTHLOGIC warrants to the original purchaser that all hardware components of the system will be free of defects in workmanship and materials for the period of your warranty from the date of invoice. During the warranty period, as stated on the Invoice, MYTHLOGIC will, at its option: (1) provide better or equal replacement parts necessary to repair the product. (2) Replace the entire unit less any software, peripherals, non-factory items, and unaffected items. Any additional purchases or upgrades will not extend this warranty. Any labor costs incurred during this warranty period, and in accordance with this warranty statement will be covered by MYTHLOGIC CORPORATION.
MYTHLOGIC's sole liability, under this warranty, for failure to repair or replace the hardware system after a reasonable number of attempts is limited to replacement or, at MYTHLOGIC's sole discretion, refund of the original purchase price. The above constitutes purchaser's exclusive remedies for breach of warranty. MYTHLOGIC shall, under no circumstances, be liable for any other damages, including but not limited to special, incidental, consequential and other similar claims whether based upon breach of contract, breach of warranty, negligence, absolute or strict liability, or any other similar theories. Damages excluded include but are not limited to: loss of profit, loss of revenue, loss of use of the hardware system, loss of use of related equipment, cost of substitute or replacement equipment, “down-time”, purchaser’s time, injury to property, and all claims of third parties.
Section 2 - TO OBTAIN SERVICE UNDER THIS WARRANTY
Call the Technical Support Department at 800.735.2515 or e-mail the Technical Support Department at: support@mythlogic.com. When a message is left either via voicemail or email; make sure to include the best time to call, the phone number, name of person to contact, and your invoice or order number. The technical support staff will assist you in diagnosing the problem over the phone if available. If the problem cannot be resolved over the phone, a MYTHLOGIC representative will require you to send the system or defective part to the factory.
Section 3 - DEFECTIVE ITEM REPLACEMENT
If there is a defect in your computer system such as defective hardware, MYTHLOGIC will cover for shipping costs and replace the part(s) within the first 180 days of receiving your computer system. After the 6 month period you will be held liable for all shipping costs, and MYTHLOGIC will honor warranty service and replacement only, not for shipping.
MYTHLOGIC will not be responsible for consequential damage to the boards or the system or any of its components caused by either internal or external equipment, shorted connections or components not installed by, or purchased from MYTHLOGIC. MYTHLOGIC will also not be responsible for damages to any components or loss of any data inadvertently caused by products, under normal or abnormal use, purchased from MYTHLOGIC.
The MYTHLOGIC “Sentinel” Warranty also does not cover damages or defects that may have been caused by: Shipping damage (other than the original shipment), improper installation or maintenance, misuse, neglect or improper environment, repair, modification, adjustment, or installation of options or parts not by an MYTHLOGIC employee, inadequate or excessive electrical power surges, or other power irregularities. MYTHLOGIC will also not replace, repair, or refund on any purchase if the item serial numbers do not match, or if the product is not sold directly by MYTHLOGIC.
Section 4 - UPGRADES
MYTHLOGIC “Phoenix” Upgrade Plan is negotiated at the time of the planned upgrade. Any upgrades applied to the system during this warranty period not completed by MYTHLOGIC will void this warranty agreement.
NOTICE: MYTHLOGIC WILL NOT BE RESPONSIBLE FOR ANY DATA LOSS ASSOCIATED WITH ANY WARRANTY SERVICE.
Section 5 – DISCLAIMER
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS WHICH VARY FROM STATE TO STATE (OR JURISDICTION TO JURISDICTION). MYTHLOGIC CORPORATION’S RESPONSIBILITY FOR MALFUNCTIONS AND DEFECTS IN HARDWARE IS LIMITED TO REPAIR AND REPLACEMENT AS SET FORTH IN THIS WARRANTY STATEMENT. ALL EXPRESS AND IMPLIED WARRANTIES FOR THE PRODUCT, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE WARRANTY PERIOD SET FORTH ABOVE AND NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WILL APPLY AFTER SUCH PERIOD. MYTHLOGIC CORPORATION DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH IN THIS WARRANTY STATEMENT OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ANY LIABILITY FOR PRODUCTS UNAVAILABLE FOR USE OR FOR LOST DATA OR SOFTWARE RESULTING FROM WARRANTY REPAIR.
Section 6- EXCLUSION OF WARRANTY
SOME STATES (OR JURISDICTIONS) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
